The committee to investigate doping
allegations against Kenyan athletes will be
unveiled on Monday.
The probe has been prompted by the
World Anti-Doping Agency (Wada). The
agency gave Kenya uintil the end of this
month to develop a report after the
number of athletes found to have been
using banned substances had risen from
two between 2010 and 2012 to 17
between January and September this
year.
Cabinet secretary for sports, arts and
culture, Hussein Wario said they had
received the directive to form the inquiry
committee but several factors has
contributed to the delay.
“We are still within time,” said Wario.
“Forming such a committee is not an easy
undertaking. We needed time to identify
people to seat in the committee and as
well make sure they are the right
people,” he added.
“We were also not working alone on this.
We have to also involve the office of the
Attorney General. There are so many
procedures to be observed.”
Wario added there is also the budgetary
challenge since this committee will have
to do their investigations by researching
far and wide and this will definitely come
at a price.
“We are not only dealing with this issue
alone,” said Wario adding “there are many
things involved which need be taken
seriously.”
Last week, it was revealed Kenya faces
censure from the International Olympics
Committee for failure to cooperate with
Wada.
The Kenyan doping issue is expected to
dominate Wada’s conference on doping in
sport in Johannesburg later this month.
Athletics Kenya president Isaiah Kiplagat
said it was the ministry which was
contributing to the anxiety after failing to
comply with the Wada directive.
“They (ministry) were supposed to form a
committee and as we are speaking, the
information we have is that names of
committee members are with the
Attorney General awaiting gazzetement,”
Kiplagat said last week.
“We have, on our part fully cooperated
with Wada, knowing that we have already
banned some athletes who have been
found culpable.”

Ati Borussia who? Ati Liverpool who? And
on Monday I’ll be saying “ati Manchester
United who? Okay, let me not get too
cocky about games that haven’t been
played yet because I often find myself
with egg on my face. What I like about
the current Arsenal is what I have always
admired of Manchester United. Even
when they have a bad game, they win; or
at least they avoid defeat. The norm for
any normal team is that when you play
badly, you lose. Ironically Arsenal over
the years have gone through periods of
playing well but still losing. Even when
Man United never had a strong team,
somehow Sir Alex Ferguson would make
them reach deep inside themselves to
find the will to win and that alone would
carry them. Arsenal have developed that
drive regardless of what the stats are
saying.
Arsenal did not have the greatest game in
the world against Dortmund midweek
even though all Gunners went to twitter
at 1am in the morning to say: “Bring on
United!” Infact at some point the German
club had 13 shots on and off target while
Arsenal had two. That should say
something about the way the teams were
playing. Arsenal’s first shot on target was
Aaron Ramsey’s goal and that came in the
62nd minute! So what were we doing for
the first hour of the game ? Defending.
And I must say it also had a lot to do with
“Lady Luck!” The number of times the ball
went just wide of Wojciech Szczesny’s goal
were too many for my comfort. We must
seal those defensive loopholes before
meeting United on Sunday and our
strikers must become sharper.
Theo Walcott is back which is great news
but I’m not sure whether he should be
rushed into this game or brought in as a
super sub. Either way it’s great news as
Arsenal suffers when critical players are
injured. But to be honest, I’m cautious
about Man United simply because they
are Man United. They grind points out of
the most difficult games for them and
usually they don’t lose or draw two games
in a row. Midweek they failed to score
against Real Sociedad settling for a 0-0
draw. All their strikers were shooting
blanks from RVP missing a penalty to
Chicharito giving All Black’s Danny Carter
a run for his money! I must add that
despite beating Liverpool 2-0 I have
massive respect for the Reds. Arsenal had
such a good game against them and the
scoreline didn’t altogether reflect the
challenge they gave us. So big up to the
losers; you lost well.

Series leaders Tejas Hirani, Anish
Chauhan, Baldev Chager and Amit Pandya
will be the star attractions during the
eighth round of the national auctocross
series slotted for this Sunday at Athi
River’s Portland Cement racetrack.
Chager, who recently won the Classic Car
Cup in Kilifi Rally in Onkar Rai’s Porsche
911, will return to circuit racing in a
blindngly fast and chopped up Subaru N10
which is an ex-Tundo rally car. After
winning the KNRC at penultimate stage in
October, Chager hopes to seal a rare
double in the open class and will be up
against his team-mate Onkar Rai. Among
those expected in the Athi River meeting
are Samir Khan, Shazz Esmail and Bobby
Sehmi who came in third overall in
Mombasa— followed by Amit Bhatt.
After seven rounds, Pandya consolidated
his lead in 2WD Turbo series to 122.
Sehmi and Bhatt now tie on 104 while
Samir Khan remains in fourth place with
70 points. Tejas requires a solitary point
to clinch his maiden autocross
championship in the 2WD non-Turbo
class, which he has led from the second
race to date.
Series leader Amit Pandya and his
namesake Amit Bhatt have fought a good
battle in the 2WD Turbo class but the
former has had an edge winning in the
recent MMC autocross staged in Miritini.
Tejas, a Year 8 student at St. Austin’s
Academy, has been practicing really hard
this season having been to the Formula
One BMW Academy in Germany for trials
which came to fruition. He was also
recently in South Africa where he caught
the eye of the trainers at the FIA
Institute’s 2013/14 Young Driver
Excellence Academy. He reached the
finals but failed to secure the single slot
allocated to the African continent.
All that Tejas needs to do to seal the 2013
deal and by extension chalk-up his
maiden autocross diadem. Sachin Choda,
who retired in the MMC round has an
outside chance as he must win the last
two events with bonus points and hope
that Tejas doesn’t score any points at all.
Choda is expected to share a Rage Buggy
with Gurmeet Mehta. Winning the Coast
tour improved Teja’s tally to 136 points.
Sachin remains a distant second on 93
points and would score a maximum of
137 points should he triumph in the last
two with bonus points.

Kenya Sevens skipper Andrew Amonde
has hailed the arrival of head coach Paul
Treu and expects him to improve Kenya
fortunes on the International Rugby Board
World series.
Amonde who was named the new
Guinness, “Make It Happen” brand
ambassador on Wednesday said the new
bench headed by Paul Treu will play an
integral part in assisting Kenya’s
qualification to the 2016 Olympic Games
in Rio de Janeiro, Brazil.
“He is a proven winner and champion and
we expect to take our game to the next
level and look forward to winning a leg of
the IRB Sevens series this year” added
Amonde
Amonde said there is a positive vibe at
the Kenya team with the arrival of Treu,
attack coach Vuyo Zanqa and strength and
conditioning coach Graham Bentz.
“We are sharing ideas with them and thy
are training us hard on all aspects of the
game. As a team we expect to improve
going forward,” Amonde said.
The KCB forward said competition for
places will be stiff with the tough legs
coming up in Dubai and Port Elizabeth at
the end of the month.
“Its going to be two tournaments in a row
so our strength and conditioning has to
be excellent for the two events. There
will be no time to rest so in the next
three weeks we really need to work
hard,” added Amonde
When asked about Kenya’s pooling in
Dubai which will feature New Zealand,
Portugal and France Amonde said its
going to be tougher than Gold Coast.
“France are a decent side and have
beaten us before. We really have to be in
good shape to face them, Portugal are a
very tricky side who on their day can
upset any team and New Zealand are the
world champions so it will a tough pool
for us “ Amonde said.

THREE more teams have pulled out of the
forthcoming Africa Cup of Nations hockey
championship scheduled for November
18-24 at the City Park Stadium, Nairobi.
Namibia, Nigeria and Seychelles exited
the event— bringing the to number of
teams that have withdrawn to four. Egypt
were the first to pull out citing lack of
training time following the political
upraising in the Northern Africa country.
Seven countries with representation of
both women and men teams were slated
to participate in the championship, apart
from Tanzania who will only send a
women’s team.
Hosts Kenya, South Africa, Ghana and
Tanzania are the only remaining teams
expected to honour the show.
National coach Meshack Senge registered
concern over the mass withdrawals but
was quick to say that the move could
work to their advantage. “This is a good
chance for us to qualify for the World
Championship,” he said. He, however,
said there are no pushovers in the
tournament and the competition will be
tight.
Senge, who also doubles up as Strathmore
University coach, observed that they have
heard enough time in training and the
players are focused.
“Of course the changes in date have had
negative impact on my players but I
believe they are now focused,” he added.
The event was initially set for September
25 to October 5 but the dates were
moved forward due to Westgate Mall
terror attack.
Asked whether there was a possibility of
the tournament being hit with a low turn
out, Kenya Hockey Union (KHU) vice
chairlady, Elina Shiveka, said there priority
is to stage the event but exuded
confidence that they will form a quorum.
She said, “As the union, we are not
responsible for who graces the occasion
or who doesn’t. Our main goal is to
ensure the event is seccussful,” said
Shiveka.

KAKAMEGA Homeboyz have cautioned
AFC Leopards not to expect victory or a
draw on a silver platter in their
tomorrow’s Premier League match at
Mumias Sports Complex.
Club chairman, Cleophas Shimanyula, said
the future of the club lies on the outcome
of the match which they need to win to
escape the big axe. Homeboyz are placed
15th on the table with 29 points. They
need to win the match and pray that Sony
Sugar who host Bandari in Awendo
tomorrow drops at least a point or City
Stars drops three points away at Chemelil.
Expressing optimism of beating ‘Ingwe’ in
Mumias, Shimanyula admitted they are
the underdogs but noted that tomorrow’s
match is a do-or-die for them.
“Our opponents have the experience,
money and everything but they have no
luck of beating us in tomorrow’s match.
We have psyched our boys to summon all
their energy for this match. All I can ask
Leopards is to play with respect and bear
in mind that they are meeting their
brothers whose survive in the league
depends on the match,” Shimanyula said.
He said Homeboyz who made their debut
in the Premier League this year’s, started
off the season on a poor note but
recovered late.
“ Like any other team, we want to remain
in the Premiership and that is why we are
promising to play a game of our life,” he
added.
“To confirm we are the team to watch, we
won two consecutive matches at home—
beating Chemelil and Thika United—by an
identical 2-0 margin. We are optimistic
that the trend will continue against
Ingwe.”
He urged the club supporters to turn up
in large numbers and cheer the team to
survival in the match which starts at
3:00pm.
He said Dennis Mukaisi and Andrew
Kulecho, who have scored four goals
apiece, will spearhead their campaign as
they strive to remain in top flight football
next season.
Shimanyula said the team is a community
club with no sponsorship but the players
have remained united despite the
problems.
Leopards will also be hoping to win the
match to finish in second position ahead
of Sofapaka. They are currently tied with
Sofapaka in second place on 47 points but
Leopards have a superior goal aggregate.

Elsewhere, Nairobi City Stars coach Jan
Koops has given the clearest indicator
that he is set to join former Kenyan
Premier League champions Tusker after
confirming that tomorrow’s match against
Chemelil Sugar will be his last at the club.
Koops has been linked with a move to
Ruaraka with sources at the club,
revealing that he is set to be unveiled
next week— to take over from besieged
Robert Matano.
On Thursday, Koops confirmed that his
short contract with City Stars expires
after tomorrow’s fixture but remained
non-committal about his future.
“My agreement with City Stars was for
two months and this comes to an end
after Saturday’s match in Chemelil. I have
already told the management and will tell
the players before we play on Saturday.
“At the moment, my focus is to help City
Stars survive and then we can think about
the future. Let us talk about this next
week,” he said when pressed further. City
Stars chairman Peter Jabuya said it is
unfortunate to let Koops go and
confirmed that indeed they had a short
term contract with the coach.
“Our agreement was for seven matches
after which we would sit down ad agree
on a longer term engagement if he is still
interested. At the moment, our focus is
on how we can survive relegation and the
issue of the coach can come later.”

Despite his young age of 19, Lenila
Lebarlaya Peter holds a top position
among the Samburu community.
The Form 3 student at Oldonyiro
Secondary School in Isiolo County is

More than 9000 people have been injured
in road accidents this year. Traffic
commandant Samuel Kimaru says nearly
3000 people also lost their lives in the
same period in accidents mainly caused
by human error.

A German tourist accused of killing his
Kenyan wife and hiding the decomposing
body for three days has been set free.
Michael Ribcke was acquitted by High
Court Judge Maureen Odero who ruled
that the tourist was of unstable mind
during and after the killing in Bamburi in
Nyali.
Odero said the prosecution failed to
provide sufficient evidence to link Ribcke
to the murder.
Ribcke was found lying in bed with the
decomposing body of his newly-wedded
wife, Esther Igoki.
Neighbours called the police after an
overpowering stench came out of the
couple's house in Vescon, Bamburi on
December 8, 2010.
Yesterday Ribcke told the Star that he will
leave for Germany on the next available
flight.
“Staying in the Shimo la Tewa prison was
hell for me. I regret the death of my wife
but I find it good that the courts found
me not guilty,” he said.
Judge Odero ruled that Ribcke was of
unsound mind as noted by a psychiatrist
who treated him for three days before he
was declared mentally fit to plead to his
charges.
“In the P3 form filled at the police
station, it is noted that he looked sick and
depressed. The psychiatrist testified that
he was mentally disoriented and suffered
mental sickness,” Odero said.
“Indeed for a man to remain holed up in
a house with a badly decomposing
stinking dead body is clear evidence of an
unsound mind.”
An autopsy report by a government
pathologist also assisted Ribcke’s acquittal
as the judge said the doctor did not give
the exact cause of death.
A Coast General Hospital pathologist, who
performed the autopsy, said the deceased
died from asphyxia due to the presence
of mucus on the vocal cords.
The pathologist acknowledged the
difficulty of performing an autopsy on the
decayed body but said there was no sign
of strangulation or poisoning.
“Choking can cause asphyxia. Even
inhalation of food but not food stuck in
the throat. The choking can be common
with people who take alcohol but not
necessarily a lot of alcohol,” said the
pathologist.
During the trial Ribcke told the court that
he slipped into a state of unconsciousness
after a drinking spree with his wife and
brother-in-law, and then woke up in
hospital.
However, this argument was dismissed in
court.
“I find the accused defence as utter lies
and an afterthought. I am not persuaded
that there is any truth to this defence. I
reject this in its entirety but the onus to
prove lies in the prosecution,” Odero
said.

NANYUKI town residents have stopped
using water from the Nanyuki River after
chemicals were dumped in it on
Wednesday. They said the water turned
blue and they immediately alerted the
concerned authorities.
Officers from the National Environment
Management Authority, the Water
Resources Management Authority and
public health officers have warned
residents against using the water until
the chemicals are analysed. A bag
containing two types of chemicals was
retrieved from the riverbank at the
Sportsman’s Arms Hotel bridge. Nanyuki
River Water Users Association chairman
David Njoroge said the pollution was
noticed by people who wash vehicles near
the river.
Dominic Kibaya, an officer from Warma,
and Joel Mbugua from the public health
department said samples of the substance
and the water have been taken to the
government chemist for testing and
analysis. Mbugua said his officers poured
chlorine in the river to dilute the
chemicals which may turn out to be
poisonous.
The officers said the water is dangerous
as it has changed its colour. “The
substances are orange and dark blue in
colour. Because we have not known what
they contain, it is advisable for people
living downstream and their livestock to
refrain from using the water” Kibaya said.
The river serves thousands of residents
and livestock downstream in Mukima, Jua
kali, Kimugandura and other areas.

The Deputy President’s office has
promised to get to the bottom of the
matter involving the alleged loss of
documents used in the hire of the
hustler's jet.
The aircraft was hired to take Deputy
President William Ruto on a tour of four
African countries in May.
The Chief of Staff in Ruto's office
Marianne Kitany yesterday told the Public
Accounts Committee of the National
Assembly that investigations have been
launched into the loss of the LSOs and
why the LSO that approved the payment
was not signed by the accountant
responsible.
“I will ensure that the investigations are
concluded in time so that those at fault
are brought to book,” she said.
Kitany said that apart from the Somalia
security issues, the trip was organised to
increase intra-Africa trade and
repatriation of the more than 500,000
refugees currently in camps in Kenya.
She said the trip to Nigeria, Algeria, Congo
and Gabon came ahead of the African
Union summit, where the Somalia
situation was to be featured prominently.
On Tuesday, two officers behind the
procurement process gave different
accounts before the committee.
Evans Nyachieo, the head of procurement,
and his junior Simon Okoth have since
been transferred to Industrialisation and
Treasury ministries respectively.
Okoth, the former custodian of the LSOs
at the DP’s office, told the committee
that no document was lost and he is not
aware of any internal communication to
the effect.
He said the alleged lost documents had
indeed been used for a different
procurement under the title Uniglobe.
Nyachieo however said he had notified all
his staff of the loss through internal
memos.
The chairman of the committee,
Budalangi MP Ababu Namwamba, later
accused Nyachieo of perjury and recalled
him for further questioning.

DEPUTY President William Ruto has
denied that financial budget meant for his
office has been transferred to the
Presidency.
The Star published a story yesterday that
the Deputy President was furious that his
budgetary allocation had been moved to
the Presidency.
The story, based on multiple sources, also
claimed some staff in the DP's office have
gone without pay for months while others
had their contracts revoked.
"The article in its entirety and fact is a
fabricated falsehood, malicious
concoctions and geared towards devious
schemes of detractors of the government
and should be treated with contempt. For
the record, the Presidency is determined
to be a service unit devoid of the big-man
syndrome and the workings are seamless,
synchronised and focused," said a
statement sent to the Star last evening.
"The Star newspaper should take the
earliest opportunity to correct the
erroneous impression it has created."
On Tuesday, Ruto is understood to have
summoned State House Controller
Lawrence Lenayapa, his principal
administrative secretary Daniel Wambura,
chief of Staff Maryanne Keitany and other
senior officials including the controller of
budget and the chief accountant to a
meeting in his Karen office.
Ruto is Uhuru's principal Deputy and can
act as President in the latter's absence.

PRESIDENT Uhuru Kenyatta yesterday
asked MPs to allow his Cabinet
Secretaries to work.
A visibly angry Uhuru complained that
Ministers were spending too much time
in Parliament because of summons by
MPs.
"The constitution does not give room for
deputy Cabinet Secretaries. How will they
work if they are made to be in one
committee after the other?
"SC's are spending too much time in
committees that even i cannot find them
when i need them to attend to state
duties. Please allow them to work," said
Uhuru
Speaking during the launch of Huduma
Kenya at Teleposta Towers, Uhuru said
CSs have been hoping from one
committee meeting to the other from the
senate to the National Assembly.
Uhuru said civil servants must undergo a
transformation and offer better services
to Kenyans or resign so that others can
take up their jobs.
"Public servants are not rulers. They must
remember the public is their employer
and must transform," he said.
Uhuru said public officers must recognise
that there is a new system of government
and must work in a manner that is
consistent with their policies.
"Everyone must begin to appreciate the
paradigm shift that comes with the
Jubilee government," he said.
The President said there is a tendency by
civil servants to seek court injunctions
when they have been sacked while they
are endangering Kenyans lives by issuing
out IDs and passports to terrorists.
"If you come back you will be interdicted
so that you can continue earning your
salary if that pleases you but we wont
allow you back," Uhuru said.
He said police should act when they are
tipped of people threatening the security
of the country.
"You have to act if you are tipped. Efforts
must not be wasted," Uhuru said.
Earlier in the day President Kenyatta put
on notice corrupt public officers, saying
their days were numbered.
Speaking at Uhuru Park today when he
presided over the official launch of the
first batch of the 1,200 motor vehicles,
acquired through an operating lease for
the National Police Service, the President
emphasized that the Government will not
endure any form of graft.
“I wish to state that the Government will
not tolerate corrupt public officers. The
time for transformation has come and
those who are not ready to change should
leave and give a chance to others willing
to serve,” he said.
The President emphasized that the
authority assigned to the officers was a
public trust which should be used to serve
the people rather than the officers.
“For those who are not ready to change,
we shall not plead with you any more,”
the President stressed.
The President disclosed that his
Government is committed to cleaning the
public service to ensure offices are
manned by men and women of integrity.
He reiterated that the Government was
committed to assuring every Kenyan and
investors their safety and security and
warned police against lax.
He pointed out that vetting of Police
officers will soon be carried out to weed
the service of all corrupt and lax officers.
The President called on the police to
ensure that their presence was felt
throughout the country to deter all
criminal activities.
Speaking during the occasion, Deputy
President William Ruto said that the
Jubilee government was keen on curbing
wastage and extravagance in the use
public resources.
Ruto said that measures were being taken
to streamline government transport to
seal off all loopholes where corrupt
officers colluded with dealers to steal
from government.
“One cannot explain why government
pays more for a vehicle from certain
dealers than individual buyers yet
government buyers in bulk and should
therefore enjoy economies of scale,” said
the Deputy President.
Present were Cabinet Secretaries Joseph
ole Lenku (Interior), Henry Rotich
(Finance), Najib Balala (Mining), and
Charity Ngilu (Lands).
Others were Inspector General David
Kimaiyo and Chairman of the National
Police Service Commission Johnstone
Kavuludi.

Angry MPs yesterday ignored court orders
and promptly debated and passed a
report recommending the removal of six
Judicial service Commissioners. The
national assembly overwhelmingly asked
President Uhuru Kenyatta to set up a
tribunal to investigate Ahmednasir
Abdullahi, Samuel Kobia, Christine Mango,
Mohammed Warsame, Emily Ominde and
Florence Mwangangi.
The hight court had the previous day
issued an order stopping the National
Assembly to referain from initiating and
the process of removing the six
commissioners.
But yesterday House Speaker Justin
Muturi said the courts cannot gag the
authority and the mandate of Parliament.
“It has never happened that someone in
their right minds can take the Parliament
of Kenya to court. This house cannot pass
resolutions that direct that criminals
appearing in court be acquitted. The court
cannot and must not direct what this
House does.
That I will defend to the hilt,” Muturi said
in reference to the high court order.
Muturi said that the National Assembly
derives the powers of oversight under
article 260 of the constitution over the
Executive, Judiciary, independent offices
and constitutional commissions. The
House turned its fury to the JSC member
only a day after it censured the conduct
of lands minister Charity Ngilu for
abrogating the law in the hiring and
transfer of senior servants a her ministry.
Among other things the Tribunal will
establish is whether other office JSC
commissioners, who serve on the finance
committee, contravened the law when
discharging their duties. The MPs claim
that documents availed to the commitee
show that he forged his practising
certificate.
Outraged MPs accused the JSC of
disregarding the House’s oversight
mandate, “Spitting in the face of people’s
representative” and acting as if they are
only “answerable to God”. Homa Bay MP
Peter Kaluma led the onslaught against
Ahmednasir saying time has come for
questions surrounding his legal
qualification to be settled “once and all”.
“It’s only fair that he is given an
opportunity to clarify this issue and prove
that he is a brilliant lawyer that he is,”
Kaluma said. Luanda MP Chris Omulele
supported Kaluma arguing that it was
improper for Ahmednasir to serve on the
JSC without the requisite qualification. “It
is improper for him to serve on the JSC
when there are serious constitutional
questions surrounding his primary
documents,” he said.
In particular Omulele, argued that
Ahmednasir, whpo represents LSK on the
JSC, should be investigated because he
was dismissive of judges qualifications
during the interviews of the judges. Ol
Joro Orok MP John Waiganjo said the JSC
had exposed the rule of impunity by
refusing to appear the committee when
summoned. “We had a job to do and we
have done it.
The refusal by the JSC is a proof of the
caliber of leadership at the judiciary,” he
said. However, attempts by three MPs
Chris wamalwa (Kiminini), Olago Oluoch
(Kisumu West) and Manson Nyamweya
(South Mugirango) to oppose the report
was met with boos from Mps.

POLICE officers protected Kalenjin youths
who were responsible for the attacks on
Kikuyus in the Rift Valley, an ICC witness
said yesterday.
The witness said that when Kikuyus went
to seek help from the police, they were
told that they were facing the
consequences of voting for Kibaki.
Chief Prosecutor Fatou Bensouda's
seventh witness yesterday said that police
guarded lorries that were used to ferry
cows that had been stolen from Kikuyu
homesteads.

police watched as people were attacked
and killed during the violence following
the December 27 election.
He described how a Yamumbi resident
was slashed as police officers watched.
"He was cut in the presence of policemen
and taken away by a driver but he was in
a very poor state. His intestines were
falling out and by the time the driver got
him to the hospital he had died. Police
also watched as houses were burnt and
looted," the witness said.
He said they were a safe distance away
and the Nandis shouted at them to collect
the body. They only went there after the
attackers left the scene.
He recounted how people identified as
number 8, number 9 and number 10 were
mercilessly cut into pieces by Nandis.
"Number nine had other people with him
but his clothes got stuck on a barbed wire
as he was trying to flee into the Langas
area. The attackers caught number 9 and
cut the body into pieces. That person
died instantly," explained the witness.
The Kalenjin youth were armed with
machetes, bows and arrows, and
sharpened sticks and were ferried in ten
lorries to the area, according to the
witness.
"At the time I did not know who the
lorries belonged to. Later, I was told to
the lorries belonged to some rich
individuals. I heard that one of the rich
people who was the proprietor of the
lorries was Mr Maiyo," the witness said.
The witness said that Maiyo, who has
since passed away, was close to Deputy
President William Ruto and the two were
were present at planning meetings.
"Maiyo lived at the top of one hill in
Yamumbi and he was very rich. Every
time there was a political meeting in the
area he would be informed and he would
attend," the witness said.
His testimony only touched on Ruto and
he did not mention the co-accused Joshua
Sang. Witness Seven will be cross-
examined by Ruto's defence lawyers
today.
He said that Administration Police officers
attached to the local chief's camp
guarded Maiyo's compound
He alleged that Maiyo's house housed the
Kalenjin youths who attacked and burned
houses in the area on December 30 and
31, 2007.
"The police also escorted the lorries
which were carrying the cows that had
been stolen. The cows were taken to
Maiyo's home," the witness said.
The same police officers watched the
burning of houses in Muiruti shopping
centre without taking any action, he said.
The witness said that another person was
killed in the presence of two policemen
who had accompanied him to ward off
attackers who had invaded his home.
"I think the police officers were Kalenjin
because I had them speak Nandi and I
understand the language. We would see
police officers on a daily basis but this did
not mean that violence was contained,"
the witness said.
The witness said that on the first night,
the attackers burnt his house and about
ten others. On the second day, the
attackers returned and burnt down
another estimated 300 houses.
"I was hiding but they could not see me.
I hid there until they left. The whole
house was on fire when I got back," the
witness said.
According to the witness, Nandi youths
took the galvanised roofing sheets that
were not badly damaged.
"After the conflict I saw that some houses
had been built using roofing sheets that
had been taken away from the burnt
down ruins. Some people had even tried
to paint them but it was still visible,” he
said.

Kiambu Governor William Kabogo has
been sued over the proposed Finance Bill.
Jamofastar Welfare Association wants the
High Court in Kiambu to block the
introduction of the bill that seeks to tax
the dead and living in the county.
The welfare group says the governor and
his team never consulted Kiambu
residents prior to drawing up the bill,
which is contrary to the constitution.
The bill proposes to tax farmers before
the carcasses of their livestock and pets
can be collected for disposal. Also
proposed is burial fees. To conduct burial
on one’s land, the bereaved will have to
ay Sh4,500 if the dead is an adult,
Sh3,000 for a child and Sh2,500 for an
infant.
Relatives of those buried in public
cemeteries in the county will pay
Sh8,000 for a permanent grave. Those
whose loved ones die in other counties
but are to be buried in Kiambu will pay
Sh10,000. Nonresidents of Kiambu will be
charged Sh25,000 for a burial place.
The families will be required to pay
Sh30,000 every time maintenance work is
undertaken in cemeteries. The revenue
raised is expected to finance Kiambu’s
Sh12.6 billion budget, which includes
Sh100 million for the governor’s office,
Sh155 million for the county assembly
and Sh515 million for education and social
services.

Machakos Senator Johnstone Muthama
yesterday failed in his bid to block today’s
launch of the proposed Machakos City.
Muthama had sought orders from the
High Court in Nairobi to stop the ground
breaking of the proposed multibillion
shilling project by President Uhuru
Kenyatta today.
Muthama says the land on which the
proposed city is to be constructed has
been irregularly acquired.
However, High Court judge Weldon Korir
rejected the senator’s plea saying he
could not issue such orders without
hearing all parties involved.
Justice Korir said the senator went to
court at the eleventh hour and he did not
show evidence that he was not aware of
the planned launch.
The county government of Machakos
plans to build modern central business
district with schools, hospitals and
residential areas of different income
levels on a 4000, acres land.
There is a dispute over the 1,425-acre
which are part Machakos veterinary farm.
Muthama said yesterday that unless the
project is stopped, the ministry of
agriculture will lose its property and the
people of Machakos will be denied the
benefits of the research carried out on
the land.
Justice Korir said it is impossible to hear
and determine the issues Muthama was
raised before today’s event.

The Coalition for Reforms and Democracy
has condoled with Nyakach Member of
Parliament Aduma Owuor and his family
following the killing of his parents in an
arson attack early this morning.
According to the police the Nyakach MP’s
mother was beaten to death in the
kitchen by four unknown men when they
attacked the home in Nyakach Kadianga
village before setting the house on fire
killing his father.
Upon noticing the inferno members of
the public alerted the fire brigade in
Kisumu who managed to put out the fire
but said the house had already been
damaged completely.
There has been no official communication
from the police about the motive of the
attack but Nyanza Regional Commander
Charles Narangwi and other top officers
from the region are at the scene.
Kisumu County governor Jack Raguma, his
deputy Ruth Odinga and Kisumu Town
West MP Olago Aluoch also accompanied
Owuor to the scene.
In a statement the Cord coalition said the
thugs may have been cattle rustlers from
the neighbourhood were on revenge
mission following Owuor’s hard stand on
cattle rustling in the area.
Aduma had protested against the rising
cases of insecurity in Nyakach
constituency. During the Mashujaa Day
celebrations last month Owuor decried
police laxity in addressing cattle rustling
stating that an overhaul of the police
force in Nyakach was needed to fight
animal theft.
Owuor had also dumped a body outside
the offices of the Nyanza provincial
headquarters to protest insecurity in
September. The Nyakach MP took the
body from Nyabondo hospital mortuary
with the family's consent.

The Ministry of Industrialization and
Enterprise Development says it is putting
in place measures that will help create
one million jobs annually within the next
three years.
The measures aim to create jobs mainly
in the leather, agro-processing, furniture,
metal fabrication and other trades in the
informal sector by the year 2016.
Industrialization Principal Secretary Dr.
Wilson Songa says that the ministry is
already laying down a foundation for this
to be achieved.
“We need to create an enabling
environment and we are working very
closely with stakeholders to ensure that
this happens and we should be able to
put in place concrete plans on enhanced
job creation within the next one year”
said Dr. Songa.
The PS also encouraged college leavers
not to eye white-collar jobs only but also
seriously consider self employment
especially in the informal sector.
“Everyone cannot be absorbed in formal
employment. That is why we call upon
those who graduate from learning
institutions to apply the entrepreneurial
knowledge they have learnt for self-
employment. The informal sector offers a
perfect opportunity for them and I would
like to tell them that they can always
count on our support,” the PS said.
The Permanent Secretary also said that
the new Micro and Small Enterprises Act
will anchor creation of a million jobs
annually in the informal sector.
This he said, will be done through creation
of a revolving fund from where
entrepreneurs can borrow money at low
interest rates. He added that most small
and medium sized enterprises find it hard
growing because of the high cost of capital
to drive them to greater heights.
The ministry also plans on working closely
with the informal sector stakeholders to
help them meet the quality and
standards of products that will promote
locally produced goods.

An application by former National Social
Security Fund boss Tom Odongo to halt
the recruitment process for a new
managing trustee for the fund has been
dismissed by the Industrial Court.
Odongo had filed the application to stop
the recruitment process until his
application challenging his sacking by
Labour Cabinet Secretary Kazungu Kambi
on July 22 is heard and determined.
While declining to give the order
Industrial Court judge Nzioki wa Makau
said it will not be in the the best interest
of the public to halt the recruitment
process until the case is determined as
the post must be filled for the NSSF to
run competently.
In August, the Labour Cabinet Secretary
told the court that he had received
received numerous complaints about
Odongo's integrity.
He said retaining Odongo will be
detrimental to NSSF and citizens, which
led them to sack him.
Odongo filed the case asking the court to
suspend the decision to terminate his
employment contract.
He argues that the termination is unlawful
because Kambi made the decision
without a recommendation from the
NSSF's Board of Trustees.
